Agp’S Reply Sought Over Challenge To Section 25 Of AtaFriday, November 28, 2008 The Attorney General of Pakistan (AGP) was summoned to appear before a bench of Sindh High Court (SHC) on Dec 15 to answer and defend a challenge to Section 25 of the Anti Terrorism Act, 1997, by Aamir Khan, leader of Mohajir Qaumi Movement-Haqiqi, a convict in a double murder case against which he has preferred an appeal. When the petition came up, the bench observed that it is a public interest litigation and various legal points have been raised by the appellant/petitioner. In case, the petition is allowed and the relevant section is struck down, the AGP may plead that he was not heard and therefore it is appropriate to have assistance from him. The petitioner challenged the section 25 (a) of the ATA under which High Courts have been barred from granting bail to the accused convicted by an ATC.
Bail application dismissed: Additional District and Sessions Judge, South Muhammad Naeem Memon on Tuesday rejected bail applications of two brothers Amir Hamza and Muhammad Saad Farooqui, who are the accused in the murder case of fashion designer Sheikh- Amer Hassan. Police’s reply termed insufficient: The brief comments filed by the Karachi police in a petition regarding a missing person were termed to be insufficient and unsatisfactory by a division bench of Sindh High Court, which asked the police officials to respect the right of freedom of citizens and to treat them all as per law. The rare observation came during hearing of a constitution petition filed by Afia Zeeshan, wife of a detenue Zeeshan Khalil. If a person is picked up in a case, he shall be produced before any court of law for lawful custody remand or shall be released after interrogation, the court observed after going through the comments by the respondent police officials. Merely a denial that such and such person is not in custody is not an appropriate reply observed the bench, which went on to direct the police officials to mount search for the missing person and inform the bench about his whereabout.
SHC orders not to arrest accused sentenced by a MTC: A division bench of the Sindh High Court (SHC) comprising Justice Khilji Arif Hussain and Justice Dr Qamaruddin Bohra, on Tuesday ordered authorities to not to arrest Qadir Bux Jatoi, an accused sentenced by a Military Trial Court (MTC), Hyderabad in a murder and treason case way back in 1979. The court ordered that brother of the petitioner shall not be arrested on arrival inside Pakistan affording him an opportunity to appear before a court of law. The court later put off hearing of the case to a date to be fixed later by the office of the court. Custodial killing case: Justice Munib Ahmed Khan of SHC on Tuesday deciding a complaint converted into a constitution petition ordered Shahra-e-Faisal Police to register an FIR in the alleged death in custody of a young boy Kishan Chand.
