Kia Dealer Punished for Delivering Old Seltos Model – Report

Now an online case has surfaced regarding a Kia Seltos owner who says that the dealer Nagashanti, KIA (Hubballi, Karnataka) has given him an older model of Seltos SUV. The owner of the Seltos won with the District Consumer Grievances Redressal Forum finding the allegations to be true.

On May 28 2020, Nagaraj Patil reserved a Kia Seltos HTK+G Smartstream 1.5 litre petrol car with Facelift+ Muffler Bumper. On July 2, 2020 the delivery was made and the owner reported no problem. Not even the owner had his first service done at the dealership.

The owner began to become suspicious a few weeks later. Internet helped him find out he had got the old Seltos HTK+ 1.5 model of the car in which the car was launched on 2 June 2020 while he has booked for the new model.

Nonetheless, the owner called the dealer asking for a new one. Us assured that matter will be investigated and resolved.

The dealer refused to replace the car later. It also gave them a Rs 23,000 extended warranty and the car the same features as the new model. The owner demanded a replacement, which the dealer refused until then. The owner contacted the District Consumer Forum.

After hearing both the parties the District Consumer Forum passed the judgement in favor of the complainant. The Kia dealer had several points marked on against it as an unfair trade practices and lack of service.

To compensate the Kia Seltos owner, the consumer forum has presented the dealership with the following options:

The complainant asks your return to the old model and delivery of the new model.
Give the complainant the choice of another new variant if the model he or she is complaining about is unavailable. Levies may be levied against the complainant for any additional applicable amount to the new variant.


After allowing interest at the rate of 8 per cent per year from the date of delivery till the date of final payment, Refund the whole sum of Rs 14,85,110 of the amount so paid.

The dealer has also been directed to pay the complainant Rs 1 lakh as compensation for inconvenience and mental anguish, and Rs 10,000 in litigation costs.
